Terms of Service

These terms are an agreement between you and Verdure Studio Limited (“Verdure”, “we”, “us”), a company registered in Scotland (company number SC896086). By creating an account or using Verdure, you agree to these terms. If you do not agree, please do not use the service.

1What Verdure provides

Verdure reads a photograph of your garden together with the preferences and location you give us, and uses artificial intelligence to produce a garden-design concept — a written plan, a visualisation, a suggested plant list and a seasonal calendar.

2Important: Verdure is guidance, not professional advice

3Your account

You must be at least 13 years old to use Verdure, and at least 18 (or the age of majority where you live) to purchase a garden project. By creating an account or making a purchase, you confirm that you meet these requirements.

You must give accurate account information and keep your password secure. You are responsible for activity that happens under your account. Tell us promptly at support@myverdure.garden if you think someone else has accessed it.

4Acceptable use

You agree to use Verdure lawfully and reasonably. In particular, you agree that:

You keep ownership of the photographs and information you upload. You grant us a limited licence to host, process and share that content with our sub-processors (see the Privacy Policy) only as needed to provide the service to you. You can delete your content by deleting your account.

If you believe content on Verdure infringes your rights — for example a photograph you own — email support@myverdure.garden with the details and we will look into it promptly.

6Our content

The Verdure website, its design, branding and software are owned by us or our licensors. The plan we generate for you is yours to use for your own personal, non-commercial garden project. Please don’t resell or redistribute it.

7Beta service

Verdure is currently offered as a beta. It is provided “as is” and “as available”: features may change, and it may occasionally be unavailable or produce unexpected results. We don’t offer a service-level guarantee during the beta.

8Pricing and payment

A Verdure garden project is a one-off purchase: the price shown at checkout, in your local currency, buys one garden — composed in full and kept for good, with no subscription. Payment is taken securely by our payment processor, Stripe. Because your plan is digital content delivered to you immediately, you will be asked at checkout to agree to that immediate delivery and to acknowledge that it waives the 14-day “change of mind” cancellation right under the Consumer Contracts Regulations 2013 — we will never charge you without that clear, up-front agreement.

Regenerating a purchased garden is included, subject to fair-use limits that keep the service healthy for everyone; if you ever reach them, we will tell you clearly and help you finish your project.

9Refunds

Under the Consumer Rights Act 2015, digital content you buy must be as described, of satisfactory quality, and fit for purpose. If a Verdure plan does not meet those standards, you are entitled to a remedy — we will put it right (for example by regenerating your plan) or refund you. If you live outside the United Kingdom, the consumer law of your own country — such as the Australian Consumer Law or New Zealand’s Consumer Guarantees Act — may give you similar guarantees that cannot be excluded. These rights always apply, and nothing in this section limits them.

We will give you a full refund or a fresh plan — your choice — if your plan failed to generate, or came back broken or empty, because of a fault on our side; if you were charged more than once, or charged in error; or if the plan is not as described, or has a significant fault we cannot put right. Because the plan is delivered instantly and you have agreed to that (section 8), we generally cannot offer a refund simply for a change of mind once your plan has been generated, or because the result was not to your personal taste — garden design is subjective, and a Verdure plan is AI-generated guidance rather than professional advice (section 2).

To request a refund, email support@myverdure.garden as soon as you notice a problem, from (or quoting) the email address on your account. Approved refunds are returned to your original payment method through Stripe, usually within 5–10 working days, and we will confirm by email; when we refund a plan, the access it granted is withdrawn. If a charge looks wrong, please contact us first — we can almost always fix it faster than your bank, and raising a chargeback without contacting us may lead to your account being suspended while we investigate.

10Our liability

Nothing in these terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud. Subject to that, and in addition to the disclaimer in section 2, we are not liable for indirect or unforeseeable losses, and our total liability to you is limited to the amount you have paid us in the 12 months before the claim (or, if you have not paid us anything, to £100). If you are a consumer, your statutory rights are not affected.

11Ending your use

You can stop using Verdure and delete your account at any time. We may suspend or end your access if you breach these terms or use the service in a way that risks harm to it or to others.

12Governing law

These terms are governed by the law of Scotland, and disputes are subject to the courts of Scotland. If you are a consumer living elsewhere in the UK, you keep the benefit of any mandatory protections of your home nation.

13Third-party links and services

Verdure links to and draws on third-party services — for example plant photographs from Wikipedia, iNaturalist and Unsplash, and the sub-processors listed in our Privacy Policy. We don’t control those services and aren’t responsible for their content, availability, or their own terms and privacy practices. If you follow a link away from Verdure, that third party’s terms apply.

14General

If any part of these terms is found to be unenforceable, the rest continues to apply. A delay in enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours to a successor of the Verdure business, provided your rights are not reduced. These terms, together with the Privacy Policy and Cookie & Storage Notice, form the whole agreement between us about your use of Verdure.

15Changes

We may update these terms as Verdure develops. We will update the date above, and for material changes we will give you reasonable notice.
